Acceptable Use Policy

We believe that handling health data is a responsibility before it is a service. The rules on this page are how we ask every customer to share that responsibility with us, by using JondaX in ways that protect the people behind the data, the integrity of the platform, and the work we have all put into making it trustworthy.

What can’t I upload?

Anything unlawful, infringing, harmful, or processed without a valid legal basis under data protection law. Spam, impersonation and fraud are also out.

What technical things are off-limits?

No. The platform cannot be used to develop, train, benchmark, or improve a product or service that competes with us.

How this AUP applies This Acceptable Use Policy is reproduced from Schedule 4 of our Terms of Service. It forms part of, and is incorporated into, those Terms. The Customer is responsible for ensuring that its Authorised Users and any third parties acting on its behalf comply with this Policy.

01Prohibited content and conduct

In short Don’t use JondaX for content that is unlawful, infringing on someone else’s rights, or harmful. Don’t upload personal data without a valid legal basis. Don’t use the platform to spam, impersonate, defraud, or break the law.

The Customer shall not use the Services to:

  • upload, transmit or process content that is unlawful, defamatory, obscene, harassing, threatening, harmful or otherwise objectionable;
  • upload, transmit or process content that infringes the Intellectual Property Rights, privacy, publicity, or other rights of any third party;
  • upload, transmit or process Personal Data without a valid legal basis under applicable Data Protection Laws;
  • send unsolicited or unauthorised advertising, promotional materials, junk mail or spam;
  • impersonate any person or entity, or misrepresent the Customer’s affiliation with any person or entity;
  • engage in any conduct that is fraudulent, deceptive, or that violates applicable law.

02Prohibited technical conduct

In short Don’t try to break the platform. No unauthorised access, no malware, no scraping, no reverse engineering, no bypassing access controls or security measures. If you have a legitimate reason to do security research on JondaX, ask us first in writing.

The Customer shall not:

  • attempt to gain unauthorised access to the Services, other customers’ accounts, or any computer system or network connected to the Services;
  • introduce or transmit any virus, malware, worm, Trojan horse, ransomware, time-bomb, or other malicious code into the Services;
  • conduct security testing or vulnerability scanning of the Services without Jonda Health’s prior written consent;
  • use any data mining, scraping, robots, or similar data-gathering or extraction methods in connection with the Services, save as expressly authorised by the Documentation;
  • interfere with, disrupt, or place an unreasonable burden on the Services or the infrastructure on which they are hosted;
  • bypass or attempt to bypass any access controls, usage limits, security measures or technical protections of the Services;
  • reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code or underlying ideas of the Services.

03Prohibited high-risk and decision-making uses

In short JondaX is not for use in life-supporting systems, time-critical emergency decisions without human review, or fully automated decisions about people (insurance underwriting, employment, credit, healthcare eligibility) without proper human oversight. High-stakes use of our outputs needs a human in the loop and compliance with the laws that apply to your specific use case.

In addition to the restrictions in clause 14 of the Terms, the Customer shall not use the Services (and shall not permit any product, service or system the Customer builds using the Services to be used):

  • as a component of any life-supporting or life-sustaining device or system;
  • as the sole or primary basis for any emergency or time-critical decision where there is insufficient opportunity for human review of the relevant output;
  • in any safety-critical context without implementing appropriate quality-assurance and review processes proportionate to the potential harm;
  • to make automated decisions about individuals (including in relation to insurance underwriting, employment, credit, or eligibility for healthcare services or benefits) without appropriate human review and without complying with applicable law;
  • for any high-stakes purpose (including clinical, diagnostic, treatment, wellness, financial, eligibility, employment or insurance decisions) without appropriate human review of the outputs of the Services and without compliance with applicable law.

04Competitive use

In short You can build amazing things on top of JondaX, but you can’t use the platform to build a JondaX competitor. That includes training models, benchmarking, or fine-tuning anything that competes with what we do.

The Customer shall not use the Services to develop, train, fine-tune, benchmark or improve any product or service that competes with the Services, or to create derivative or competing products.

05Reporting violations

In short If you spot something that breaks this Policy, on your account or someone else’s, email privacy@jonda.health. We treat reports seriously and investigate them confidentially.

The Customer shall promptly report any actual or suspected violation of this AUP to privacy@jonda.health.

06Enforcement

In short If we believe this Policy has been breached, we investigate. Depending on what we find, we can suspend or terminate access under the Terms of Service. We approach this seriously and proportionately, in line with what we have agreed in the Terms.

Jonda Health reserves the right to investigate suspected violations of this AUP. Without limiting any other right or remedy, Jonda Health may suspend or terminate the Customer’s access to the Services for violations of this AUP, in accordance with clauses 7.2 and 20 of the Terms.
